Terms of Use

These terms apply to every app published by FoldingDuo (Gami, Clamshell and any app we add later). By downloading or using one of our apps you agree to them.

Apple's licence

Our apps are licensed to you, not sold, under Apple's Standard Licensed Application End User License Agreement (the “Apple EULA”). These terms add to it. If the two conflict, the Apple EULA wins, except where an app's open-source licence gives you broader rights (see below).

Purchases

  • Prices are shown in the app before you buy. Payment, billing and refunds are handled by Apple; request refunds at reportaproblem.apple.com.
  • One-time unlocks are linked to your Apple Account and can be restored on your devices with “Restore purchases”.
  • Consumable items (such as hints) are used up when you use them and can't be restored or refunded once used, except as Apple or the law requires.
  • Free or gifted in-app items have no cash value and can't be sold, transferred or exchanged.
  • We may change the price of future purchases or the contents of free features; this won't take away something you've already bought.

Your content

Anything you create or import in our apps stays yours and stays on your device. You're responsible for making sure you have the right to use any files you load into an app.

Acceptable use

Don't use our apps to break the law, infringe others' rights, or interfere with the apps or the services they rely on (for example by tampering with purchases).

Open-source apps

Some of our apps are open source. Their source code is offered under the licence stated in the repository (for example the GNU General Public License v3). Nothing in these terms limits the rights that licence gives you to the source code; these terms cover the app as we distribute it on the App Store.

Our content and trademarks

Except for open-source code and third-party components credited in each app, the apps, their designs, levels, artwork and the FoldingDuo name are ours. Other names and trademarks belong to their owners and are used only to describe compatibility.

App by app

Gami

  • Chapter 1 is free. Chapters 2–6 are a one-time purchase; hint packs are consumable and can't be restored once used.
  • Hints you are gifted or earn have no cash value and can't be transferred.

Clamshell

  • Clamshell does not include any games, BIOS or firmware. You are responsible for only loading software you have the right to use.
  • Clamshell is free software under the GNU General Public License v3. Nothing in these terms limits the rights the GPL gives you to the source code.
  • Tips are voluntary, unlock nothing, and are non-refundable except as required by Apple or by law.
  • Clamshell is not affiliated with or endorsed by the maker of the original handheld.

No warranty

We work hard on our apps, but they're provided “as is”. To the extent the law allows, we don't promise that they'll be error-free or always available, or that they'll work on every device.

Limitation of liability

To the extent the law allows, we're not liable for indirect or consequential losses, or for loss of data, and our total liability for any claim is limited to the amount you paid for the app or purchase concerned. Nothing in these terms limits liability that can't be limited by law, or your statutory rights as a consumer.

Ending these terms

You can stop using an app at any time by deleting it. We may stop offering an app or feature; if a paid feature is withdrawn, we'll do what's reasonable for people who bought it.

Governing law

These terms are governed by the laws of the country where the publisher is established, without affecting any mandatory consumer protections of the country where you live.

Changes

We may update these terms; the effective date above will change. Continuing to use an app after an update means you accept the new terms. Our Privacy Policy explains how we handle information.
